Ukulele Kidz Camps & Clubs |Terms & Conditions

Effective December 3rd, 2022.

These terms and conditions are entered into by and between parents or guardians on behalf of their child (“Students”) and Ukulele Kidz, LLC (“Ukulele Kidz”), and shall govern and take effect upon registering their child as a Student for Ukulele Kidz camp (“Camp”) and/or Ukulele Kidz club (“Club”). Both Camp and Club shall be collectively referred to as services offered by Ukulele Kidz (“Services”). Services shall include any combination of the following: 

  1. “Online Learning” defined as Student access to and use of the Ukulele Kidz brand, operating under the alias and subpages of www.playfulpitch.com (“Website” or “Site”), including the virtual aspect of Camps or the Club (“Virtual”), and any content, videos and functionality offered on or through the Website or any third-party links and/or technology needed to execute Services. 

  2. “Offline Learning” defined as Student’s attendance and participation that occur live and in-person (”In-person”) during Camps and/ or Club meetups or jam sessions, as part of the Services facilitated by Ukulele Kidz. 

Furthermore Services shall be offered to a variety of levels including but not limited to Beginners, Intermediates, Mixed, or Any Level. 

Covid-19 Guidelines And Limitations of Liability: Sessions occur outside in the open where possible and weather permitting. For unfavorable weather, sessions occur inside. While Ukulele Kidz will do its best to operate and provide a safe environment for all, students participating in Ukulele Kidz Services do so at their own risk. Ukulele Kidz assumes no liability in the event of a Student’s exposure to Covid-19.

Registrations and Cancellations: 

  1. Registrations must be submitted online via the registration forms on the Website and fees are to be paid in full and received by Ukulele Kidz before the start of Services to confirm registration. Payments can be paid online with credit/ debit card, or via check or Venmo upon request. All fees paid are non-refundable.

  2. Students must fill out the intended registration form for the intended Services. Each Service has its specific description, student level, start date, time periods, and/or included materials and requirements, as described on the Website. 

  3. Registration fees vary based on the Services and registration forms the Student selects and submits, and any optional add-ons selected in the forms, or added during checkout. 

  4. If registration forms are submitted and no payment or only partial payment has been received before the start of camp, registration is considered incomplete and Ukulele Kidz reserves the right to suspend or terminate the Student’s access to Services until all outstanding fees are paid. 

  5. Registration closes one week prior to the start of the intended Service start dates. Ukulele Kidz reserves the right to accept or deny any registration, if registration is confirmed less than one week prior to the start of Services. 

  6. Registration closes after 15 registered Students per Camp or Club and Ukulele Kidz will not hold spots for prospective Students with incomplete registrations or partial payments. Ukulele Kidz reserves the right to expand or decrease the number of Students per Service at any time.

  7. Students are advised to attend all Offline Learning during Services. If the student is not present for Offline Learning, the student will not receive a refund or credit towards makeup Services. 

  8. In the event of Online Learning, Students are advised to complete all assignments by the due dates given in order to receive timely, personalized feedback from Ukulele Kidz. Students forfeit their rights to receive feedback, if they miss the due dates, and Ukulele Kidz reserve the right to respond or not respond to late submissions. 

  9. Ukulele Kidz reserves the right to cancel Online and/or Offline Learning, and provide a make-up session within any of its Services. 

  10. Ukulele Kidz reserves the right to dissolve, cancel or amend any of its Services when deemed necessary and transfer Students to a similar Service at an alternate period or time. If Students are unable to transfer or accept the amendment, a pro-rated refund will be given to the Student. 

  11. Ukulele Kidz reserves the right to merge Beginner and Intermediate classes into a Mixed/Any Level class depending on enrollment numbers, and likewise, separate a Mixed/Any Level class into Beginner and Intermediate classes. 

Copyright, Website Access and Account Security 

  1. All materials and content used in Ukulele Kidz Services, which includes the Website, Online and Offline Learning are copyrighted, and owned by Ukulele Kidz, its licensors or other providers of such materials and are protected by United States copyright, and other intellectual property rights laws. Students are permitted to use the materials and content facilitated by Ukulele Kidz for personal, educational and non-commercial use only. 

  2. In the event of Online Learning, Ukulele Kidz will review video assignment submissions recorded by Students (“Student Videos”) for the purposes of giving critical feedback or responses to the Student and may store Student Videos for a limited time at its sole discretion. Students are responsible for saving and archiving their own Student Videos, if desired. 

  3. If Student Videos are posted and shared by the Student to any third-party media-hosting website (e.g., SoundCloud, YouTube, Facebook, Instagram, and the like), Ukulele Kidz assumes no liability for copyrightable content and the recording of persons appearing in the video. 

  4. Students are responsible for ensuring technical arrangements necessary to have access to the Website and Online Learning.

  5. To access the Website or Online Learning, Students may need to provide sign-in codes or registration details. Students must treat such access codes as confidential and personal and not disclose it to any other unregistered person for unauthorized access. Ukulele Kidz reserves the right to disable any sign-in codes used by a Student, if there is evidence that a Student has violated these access terms herein. 

  6. Ukulele Kidz does not guarantee that files available for downloading from the internet or the Website will be free of viruses or other destructive code. Students are responsible for implementing sufficient anti-virus protection on their personal computing systems. 

  7. Ukulele Kidz assumes no liability for external hacks, phishing scams, internet fraud, cybercrime and predatory behavior from online scammers and predators that may target Students. 

General Rights, Warranties and Liabilities. 

  1. All Ukulele Kidz Services will be taught by Mrs. James, who holds the relevant qualifications to competently execute Services. 

  2. To ensure the Student achieves maximum potential from Services, parents or guardians are advised to ensure that the Student arrives at the correct time with their learning materials and instruments for Offline Learning, and to monitor the Student’s practice at home and completion of assignments for Online Learning. 

  3. Ukulele Kidz will use its best efforts to provide a safe working environment for Students, including safeguarding any Student who lists student’s allergies in the registration forms, but will not bear any liability or responsibility for any claims, damages, loss of property, personal injuries, or allergic reactions sustained by the Student during any activity associated with Ukulele Kidz, or within the premises of Offline Learning.

  4. Parents/guardians of Students are requested to keep their child at home if he or she has a cold, fever, or any infectious disease.

  5. Ukulele Kidz reserves the right to take pictures or videos of the students and/or use the student's work sample for publicity and promotional purposes, except where specifically denied by the parent in the Notes/ Additional Info of the registration forms.

  6. Ukulele Kidz reserves the right to include or exclude any individual or organization at its discretion.

Changes to Terms and Conditions: Ukulele Kidz reserves the right to include, delete or change any of the above terms and conditions with or without prior notice and amendments will be posted to this page. All changes are effective immediately when we post them, and apply to the use of the Website and Services thereafter.

Ukulele Kidz LLC  (“Company”) is committed to maintaining robust privacy protections for its users. This Privacy Policy describes the personal information we collect through the Ukulele Kidz brand, operating under the alias and subpages of www.playfulpitch.com (the “Site”) and how we may use the information we collect about you. Visitors and any users of the Site are referred to as “user”, “you” and “your” and Company is referred to as “we,” “us,” and “our.” Accessing this Site constitutes a use of the Site and an acceptance to our Privacy Policy. Use of the Site, including all materials presented herein and all online products and services (“Service”) provided by Company, is subject to the following Privacy Policy. This Privacy Policy applies to all Site visitors, customers and all other users of the Site. By using the Site or Service, you agree to this Privacy Policy, without modification, and acknowledge reading it.

Information We Collect: Information collected by Ukulele Kidz registration forms is personal information, as defined by the Privacy Act 1998 and includes parent/ guardian’s first name, last name, child’s name, child’s school, email address, telephone number and postal address. Ukulele Kidz uses personal data entered on registration forms so that parents/ guardians can identify themselves when registering a child as a Student, to be contacted about registration, and to be kept informed of matters that may be of interest. Personal information is not used for commercial purposes and is not distributed to any other organization for any purpose.

Furthermore, we are the sole owners of the information collected on this Site. We only have access to/collect information that you voluntarily give us via forms on our Site, email or other direct contact from you. Forms on our Site include contact form, sign up forms to subscribe to our Site and/or create an account, payment/order forms to register and purchase our Service. To buy from us, you must provide contact information, like name and shipping address, as well as financial information such as your credit card number and its expiration date. This information is used for billing purposes and to fill your orders. If we have trouble processing an order, we'll use information you submitted to contact you. We will not sell or rent this information to anyone.

We will use your information to respond to you, regarding the reason you contacted us. We will not share, sell, exchange, transfer, or give your information with any third party outside of our organization, without your consent, other than for the express purpose of delivering the purchased product or Service requested, e.g. to deliver your Service product or ship an order. By using any product, service or functionality originating from the Site, you hereby acknowledge and consent that we may share such information and data with any third party with whom we have a contractual relationship to provide the requested product, service or functionality on behalf of the Site’s users and customers. When you submit sensitive information via the Site, your information is protected both online and offline. Wherever we collect sensitive information (such as credit card data), that information is encrypted and transmitted to us in a secure way. You can verify this by looking for a lock icon in the address bar and looking for "https" at the beginning of the address of the Web page. Only employees who need the information to perform a specific job (for example, billing or customer service) are granted access to personally identifiable information. The computers/servers in which we store personally identifiable information are kept in a secure environment.

However,  these measures do not guarantee that your information will not be accessed, disclosed, altered or destroyed by external breaches.  You acknowledge that the personal information you voluntarily share could be accessed or tampered with by a third party and by using our Service, you acknowledge that you understand and agree to assume these risks. You agree that we are not responsible for any intercepted information shared through our Site without our knowledge or permission. Additionally, you release us from any and all claims arising out of or related to the use of such intercepted information in any unauthorized manner. Changes to Privacy Policy: You acknowledge and agree that you have reviewed this Site and this Privacy Policy and that you will continue to periodically review to be aware of any modifications. We reserve the right to amend this Privacy Policy at any time. Changes to this Privacy Policy will be posted on this page.
